1. Offer and Purchase Agreement
Offered items are – also with regard to prices - without obligation.
A purchase agreement comes to pass only when the seller acknowledges the order, at latest when ordered goods are delivered. The buyer is bound to his order for four weeks. With his order he verifies full contractual capability just as well to be of age. Orders need to be confirmed by the seller before getting valid. If the confirmation of an order differs from the order, the buyer has to revoke by letter immediately, at latest within a week after conveyance of the order-confirmation. Otherwise a purchase agreement comes to pass under terms and conditions mentioned at the order-confirmation. Any additional agreements, changes or additions are valid only when confirmed in writing by the seller.

2. Prices
The prices of our antiques and art are gross prices including the statutory sales tax, by choice the value added tax (VAT) or differential tax. VAT is not separately shown. Within the European Community an exemption for taxes is not possible. The separately shown sales tax can be refunded on export into countries outside the European Community, as soon as we receive an export docket.

3. Modes of Payment
a) Payment by Bank Transfer
On receipt of the total amount to our account with

the ordered goods will be sent to the address you specified.

b) Payment by Cheque
On receipt of full payment following the unconditional crediting of the full amount to our account the ordered goods will be sent to the address you specified.

c) Payment by Credit Card
Please complete the printed order form, don’t forget the information of your credit card – name and signature of the owner, number and expiry date of the card – send it to us as fax, our fax-no. 0049-511-34 51 15. The ordered goods will then be sent to the address you specified.

4. Dispatch
Smaller items will be dispatched by DHL or UPS, furniture will be delivered by the international operating haulage contractor Schenker. All goods will be packed professionally into wooden or special boxes in order to save them from damage. If any custom-built packaging should be necessary e.g. for crystal chandeliers, we would inform you. Dispatched goods are insured at the level of the amount of the invoice. Costs of dispatch and insurance are on behalf of the buyer. Dispatch will be effected at the sole risk of the buyer.

5. Reservation of Ownership and Handing Over
The ownership of the ordered goods shall not pass to the buyer until full payment has been received. Expanded reservation of ownership according to BGB (German Civil Code) shall be accepted. Delay of payment reserves the seller the right to cancel the purchase agreement. In the case, that the buyer re-sales the ordered good prior to fulfilment of all claims resulting from the purchase agreement, the buyer shall even now transfer all rights caused by this re-sale to Antik & Art GmbH and he shall submit to the execution of this term.

6. Withdrawal and Exchange
Withdrawal from concluded purchase is possible only before the dispatch of the bought good has been carried out. An exchange of the item is possible only, if we agree by letter. Antiques are used objects and therefore they are in principle excluded from exchange. In the case of an successful exchange, dispatch and insurance are in deviation from export law on the sole expense of the buyer.

7. Limitation of Liability
All details in the catalogue concerning authorship and signature are based on scientific publications, which were investigated and examined with the greatest care and to the best of our knowledge and belief. Should any given detail turn out to be wrong within the period of limitation, the buyer, if he wishes so, shall be reimbursed after he had returned the forged item in the same condition as it was sold to him. Any additional claims are excluded. The descriptions in the catalogue do not constitute trade descriptions within the meaning of § 459 section 2 BGB (German Civil Code). We do not assume any liability for further catalogue descriptions, which are given to our best knowledge and belief. Also we exclude any claims concerning the photos in the catalogue. Preservation status and condition of the objects are corresponding with their age. Faults or defects will only be mentioned, if the overall impression is disturbed.

8. Period of Limitation
Every reserved right of the forgoing conditions expires two years after the date of sale.

9. Legal Validity and Place of Jurisdiction
Should any provision hereof become wholly or in part ineffective, the validity of the remaining provisions shall not be affected thereby. Any ineffective provision shall be replaced by a similar provision of the BGB (German Civil Code). Legal relationship between buyer and seller shall be governed by the law of the Federal Republic of Germany. The unified law governing the international sale of movable goods and the unified law regarding the exclusion of international sales contracts for movable goods are excluded.

Place of fulfilment and of jurisdiction is by arrangement Hannover, Germany. In case of dispute, the German version of these Conditions of Sale shall prevail.
